Courts cannot initiate criminal cases in Uzbekistan

Tashkent, Uzbekistan (UzDaily.com) -- Senate of Oliy Majlis of Uzbekistan approved a law “On introduction of changes and amendments to some legislative acts of Uzbekistan in connection with further reforms of judicial-legal system” at its session on 30 August 2012.
The law was developed in line with the concept for further deepening democratic reforms and forming civil society in the country.
The document introduces changes to law “On prosecutors”, law “On courts”, Criminal-Procedural Code, Civil Procedural Code, Economic Procedural Code of Uzbekistan.
It envisages judicial order of use of procedural constraints such as firing from the post, placement of person to medical establishment. It also abolishes right of court to open criminal case, etc.
The law will strengthen judicial control at holding an inquest and preliminary trial, expand use of habeas corpus in criminal process, and help to strengthen guarantees protection of rights and freedoms of people in criminal process.
