Tashkent, Uzbekistan (UzDaily.com) -- President of Uzbekistan Shavkat Mirziyoyev signed a law “On Public-Private Partnership”.
In accordance with the Law, a public-private partnership is a legally binding partnership between a public partner and a private partner, based on pooling their resources for a public-private partnership project.
The Agency for the Development of Public-Private Partnerships under the Ministry of Finance will implement the state policy in the field of public-private partnerships.
The law defines the rights and obligations of parties to a public-private partnership.
A public-private partnership project may be initiated by a government body (organization) and / or an individual entrepreneur or legal entity.
A public partner shall enter into an agreement on public-private partnership with a private partner, determined by the results of a tender or direct negotiations.
Tender criteria should be clear and not discriminatory.
The term of a public-private partnership agreement shall not be less than three years and shall not exceed forty-nine years.
The parties to a public-private partnership agreement are liable for the failure to fulfill or improper performance of their obligations in accordance with the law.
If the subsequent legislation of the Republic of Uzbekistan worsens the conditions for investing in an object of public-private partnership, then the law in effect at the date of its conclusion shall apply to the private partner within ten years from the date of conclusion of the agreement on public-private partnership.
This Law enters into force after one month.
