President of Uzbekistan signs law on business ombudsman

Tashkent, Uzbekistan (UzDaily.com) -- On 29 August 2017, President of Uzbekistan Shavkat Mirziyoyev signed a law “On the Commissioner for Protection of Rights and Legal Interests of Entrepreneurs of Uzbekistan”.
The law was passed by the Legislative Chamber on 14 August 2017 and approved by the Senate on 24 August 2017. The law came into force on 30 August 2017.
According to the law, the commissioner is an official, who provides guarantees for protection of rights and legitimate interests of business entities, observance of these rights and legitimate interests by state bodies, including law enforcement and supervisory bodies.
The Commissioner is appointed to office and dismissed by the President of the Republic of Uzbekistan.
A citizen of the Republic of Uzbekistan, who has reached the age of thirty with university degree and experience in the field of protecting the rights and legitimate interests of business entities or entrepreneurship, as well as permanently living on the territory of Uzbekistan for at least last five years can be appointed to this post.
The Commissioner for Protection of the Rights of Entrepreneurs is required to suspend or terminate his membership in a political party for duration of his duties. Business-ombudsman cannot engage in other types of paid activities, except for scientific, pedagogical and creative activities, the law says.
According to the law, the main tasks of the Commissioner are: to participate in the implementation of the state policy in the field of entrepreneurship, to protect the rights and interests of entrepreneurs, to provide them with legal support, to assess the effectiveness of the impact of the adopted acts on the development of entrepreneurial activity, and to prepare proposals for improving legislation in this area.
The law will open wide opportunities for ensuring and protecting the rights and legitimate interests of business entities. Business ombudsperson will not only assist local business entities, but also foreign companies, operating in Uzbekistan.
At the same time, the law sets cases, in which business-ombudsman cannot take part. These are economic disputes between entrepreneurs, disputes arising from family, labor and other legal relationships, which are not related to entrepreneurship, as well as issues referred to competence of the courts, bodies that carry out operational-search activity, investigation, inquiry and execution of punishment.
