Uzbekistan to protect private property, guarantee rights of proprietors
Tashkent, Uzbekistan (UzDaily.com) -- A draft law “On protection of private property and guarantee of proprietors’ rights” has been developed in Uzbekistan.

Uzbek President Islam Karimov proposed to adopt the law “On protection of private property and guarantee of proprietors’ rights” in November 2010. He said that the law will strengthen main guarantees of the state on property rights, which is foundation of market economy.

The low consists of four chapters and 31 articles. The law is directed at strengthening rights and protection of private property, creation of the system of reliable guarantee for its inviolability.

According to the draft law, right to private property is right of persons to own, use and handle property, purchased by them in line with the legislation.

The document said that the guarantee of right to private property as necessary conditions and methods, setting and strengthening its actual implementation, ensure its protection in case of violations.

Subjects of private property rights are individuals, business entities and associations, cooperatives, public unions, public funds and other non-governmental legal entities.

The draft law said that any property, excluding separate types of it, civil turnover of which banned by legislation, can be private property.

Proprietors at execution of its rights of ownership, use and handling should not violate rights and interests of other persons. Proprietors should also conduct necessary measures to prevent damages to health of people and environment, the document said.

Each individual and non-governmental legal entity has right to private property. The government guarantees realization of right to private property, secures constitutional rights of private proprietors, freedom of economic activity, entrepreneurship and labour, equality and legal protection of property along with other forms of ownership.

The document said that private property is not limited on number and cost. It is not allowed to limit the growth of property of private proprietors. Private property along with other forms of ownership is inviolable.

The Government secures inviolability of right to private property and is guarantor for protection of rights and interests of proprietors. Illegal infringement to private property persecuted in line with the legislation.

According to the bill, forced seizure of the private property only allowed in the cases, indicated in the legislation.

Right to private property ceased in case of alienation of own property, refusal of proprietors from ownership rights, abolishment of rights to property, purchase of property of private proprietors for state and public needs, nationalization, etc.

The right to private property has unlimited duration. It is not allowed to set term to owning, using and handling property.

The draft law said that private property, originated in privatization of process of the state property, is untouchable. Privatization results cannot be reviewed and abolished.

State bodies and officials cannot interfere to carrying out rights to private property, the draft law said.

According to the document, seizure of property for state and public needs is conducted through nationalization, requisition only after preliminary and full compensation market value of property, including lost profit, etc.

Purchase of land, owned by legal entity and individuals, including foreign ones, with the trade and service objects or habitation or other building for state and public needs is carried out in line with decision of local administrations or Cabinet of Ministers of Uzbekistan.
