Tashkent, Uzbekistan (UzDaily.com) -- By the Resolution of the Cabinet of Ministers from 10 July 2020 No. 433 “On measures to create favorable conditions for the restoration and development of the tourism sector in the Republic of Uzbekistan”, the following provisions were approved:
- On the procedure for providing accommodation services on the territory of the Republic of Uzbekistan (1);
- On the procedure for organizing hostels in the Republic of Uzbekistan (2);
- On the procedure for maintaining the Unified Electronic Register of Housing Rentals and its certification (3).
In accordance with Regulation (1), the requirements for hotel services, including their volume and quality, if other requirements are not provided for by law, are determined by agreement between the contractor and the visitor (customer). In this case, the price of the room (seat) is set by the performer independently.
Hotel services should be provided regardless of the place of residence (registration), citizenship, family and marriage relations of individuals, as well as other factors limiting the right to privacy.
The internal rules for the provision of hotel services and their use are communicated to the visitor. From the moment of arrival of the visitor to his departure from the accommodation facility, the rules of the legislation on the inviolability of housing are applied to the room (place) occupied by him.
Accommodation facilities must be certified by the State Unitary Enterprise "Center for Certification of Tourism Services" under the State Committee for Tourism, and correspond to the established category.
Information about the hotel must be posted in a place accessible to visitors, as well as on the official website (if available).
The regulation also contains:
the procedure and conditions for the provision of hotel services, including booking rooms, a package of free services;
responsibility of the performer and the visitor.
Regulation (2) defines the procedure for organizing hostels and providing them with services.
The owners of hostels have the right to provide hotel and temporary accommodation services only after they are included in the Unified Register of Guest Houses and Hostels (hereinafter - the Register). The Regulation contains the procedure for including hostels in the Register and removal from it, as well as the procedure for maintaining and updating the information database of the State Committee for Tourism.
To be included in the Register, copies of the conclusions of the authorized bodies supervising fire and sanitary and hygienic safety, as well as confirmation of the hostel’s compliance with the established requirements of regulatory documents on standardization, must be attached to the application.
For newly created hostels, within one year from the date of their commissioning, instead of the above documents, a copy of the act of the state commission on acceptance into operation may be submitted.
The authorized body can examine the compliance of hostels with the requirements of the Regulation and standardization regulations. Monitoring is carried out by:
study of the compliance of accommodation facilities and their services with the established requirements;
questioning of visitors (tourists) of hostels in the form approved by the authorized state body.
Regulation (3) determines the procedure for keeping records of rental housing and residents living in them in the current automated special electronic program, as well as their certification and maintenance of the Unified Register of Rental Housing.
The regulation establishes that the owners - individuals and legal entities who rent out accommodation to tourists for a period of up to 30 days, must register their accommodation for tax purposes, as well as temporary registration of tourists at the place of stay. Only after registering with the Register, they are entitled to rent out housing.
Simplified certification and maintenance of the Register are carried out by the State Unitary Enterprise "Center for Certification of Tourism Services" under the State Committee for Tourism. The application submitted to the Center online and the necessary attached documents are considered within one day. Based on the results of the consideration, the housing is entered into the Register and a message about this is sent to the owner automatically using a QR code.
Rented housing must meet the requirements of the state standard "Travel services, accommodation facilities and general requirements." The landlord is also responsible for the fire and hygiene safety of the home.
The fee for considering an application for entry into the Register for each housing is:
for individuals (individual entrepreneurs) - 50% of basic estimated value;
for legal entities - 1 basic estimated value.
The Regulation also contains:
the procedure for monitoring compliance with the established requirements by the home owner
rights and obligations of home owners and the Tourism Services Certification Center.
