The procedure for the privatization of non-agricultural land plots has been changed

Tashkent, Uzbekistan (UzDaily.com) -- President of Uzbekistan signed the Law "On the privatization of non-agricultural land".

It defines the objects, subjects, forms and procedure for the privatization of land plots, the legal status of privatized land plots, the powers of government bodies in the field of privatization of land plots.

According to the Law, the following lands can be privatized:

land provided to legal entities for business and urban planning activities;

land provided to citizens for individual housing construction and home improvement, entrepreneurship and urban planning (previously, the privatization of individual entrepreneurs was not envisaged);

land on which the privatized state facilities are located (previously this was not allowed).

Land plots are privatized in the following forms:

purchase of land owned by the right of life tenure;

purchase of land through an electronic online auction.

Funds from privatization are directed to the state budget (previously, they were directed to the Urbanization Development Fund).

The application is submitted through the CSU or EPIGU (my.gov.uz).

The application is considered, and a positive or negative decision is made in the form of a notification. 

A negative decision must be justified.

The grounds for refusal to privatize are:

lack of grounds for privatization;

the presence of unfinished court cases in relation to land;

the existence of a ban or arrest imposed on real estate objects located on the privatized land plots;

the presence in the approved master plans of settlements, projects of detailed layouts of parts of the settlement that impede the privatization of land plots;

availability of a decision on the withdrawal of land plots for state and public needs;

the presence of a ban on the sale or other alienation of the privatized land plot;

discovery in the application of inaccurate, contradictory or distorted information;

non-payment for the privatized land.

Refusal to privatize for other reasons is not allowed.

Free land plots are privatized through an electronic online auction.

The state order for the title to land is issued by the State Asset Management Agency within 1 business day after the payment for the land.

Withdrawal of a privatized land plot from the owner is allowed only in the following cases:

foreclosure on a land plot according to executive documents; 

redemption of a land plot for state and public needs;

confiscation of a land plot;

land requisition.

Nationalization (transfer of privatized land for a certain payment to the state) is excluded from the Law.

The law comes into force on the day of its official publication, according to the legal channel of the Ministry of Justice.
