Tashkent, Uzbekistan (UzDaily.com) -- At the forty-second plenary session of the Senate, the Law "On amendments and additions to the Code of the Republic of Uzbekistan on administrative responsibility in connection with the improvement of the procedure for determining the amount of an administrative fine imposed for non-execution of executive documents" was considered.

During the discussion, it was noted that in recent years our country has been improving the mechanisms for the execution of judicial acts and acts of other bodies, creating convenience for the population in the implementation of enforcement processes in order to reliably protect the rights and freedoms of citizens.

The senators noted that despite the work done, there are still some shortcomings in the enforcement of executive documents, it is necessary to make appropriate changes in this area.

In particular, the application by the Bureau of Compulsory Enforcement of an administrative fine to the debtor in the event of late repayment by the debtor of the debt subject to collection under the executive document is fixed. The legislation stipulates that the amount of this fine, in accordance with the Code of Administrative Liability, can be determined in relation to citizens from 300 thousand to 1.5 million soums, in relation to officials - from 1.5 million soums to 3 million soums.

The senators particularly focused on the fact that even if the amount of debt payable by the debtor is less than the minimum amount of the fine, the imposition of a high fine is a violation of the principles of social justice, which is the cause of just dissatisfaction of debtors, and such a situation naturally has a negative impact on the solvency of citizens.

This is eliminated by law by introducing appropriate amendments to the Code of Administrative Responsibility.

In particular, the rule is included, according to which the amount of the applied administrative fine cannot exceed the amount established for collection in the executive document.

It is also established that the Chief State Executor of the Republic of Uzbekistan, the chief state executors of the Republic of Karakalpakstan, regions and the city of Tashkent, their deputies, as well as heads of district ( city) departments of the Bureau of Compulsory Enforcement under the General Prosecutor’s Office of the Republic of Uzbekistan.

The senators noted that the adoption of the Law serves to reliably protect the rights, freedoms and legitimate interests of citizens, to impose a fair fine on a debtor for non-execution of an executive document, to prevent abuse and corruption cases in the system of the Compulsory Enforcement Bureau, as well as to strengthen control.

The law was approved by the senators.
