State Tax Committee launches a service for checking business partners

Tashkent, Uzbekistan (UzDaily.com) -- The Tax Committee has launched the Due Diligence service, with the help of which entrepreneurs can check business partners. The list of "doubtful" includes almost 400 enterprises.

The State Tax Committee of Uzbekistan announced the launch of the Due Diligence service to check business entities for the fact of dubious transactions and non-payment of taxes.

The check will help to verify the counterparty’s ability to fulfill obligations under the transaction (operation), that is, the availability of an appropriate production base and personnel, its financial condition and business reputation, the State Tax Committee explained. In addition, you can check whether the counterparty is registered with the tax authorities as a VAT payer.

“Expenses incurred by a taxpayer in transactions with counterparties who have not fulfilled their obligations to him are not recognized if this taxpayer did not show due diligence when concluding the transaction,” the State Tax Committee recalled.

The committee said that a list of 396 enterprises that make dubious transactions, in which the amount of taxes is illegally reduced, has already been formed.

Criteria by which dubious organizations are identified:

the presence of unpaid taxes in the amount of over 100 million soums;

unreasonable frequent change of the legal address (three or more times a year);

implementation of works (services) in large volumes in a short period of time from the moment of creation, underestimation of the number of officially employed workers;

storage, use and sale of unregistered goods;

initiation of bankruptcy as a result of joining other business entities with unpaid taxes;

the specified address of the taxpayer matches the address of three or more legal entities declared bankrupt or taxpayers with a high risk of tax evasion;

non-payment or incomplete payment of taxes by abuse of the right or the conclusion of imaginary (sham) transactions.

Enterprises included in the list of "doubtful" will not be issued a VAT taxpayer certificate (or will be canceled), or the amount of VAT will not be taken into account, including from their counterparties.

“396 enterprises included in this list, and about 10 thousand of their counterparties, have been sent appropriate notifications. If they provide updated tax reports and pay the amount of due taxes, then there will be no tax consequences and it is possible to exclude them from the list,” the State Tax Committee noted.
