Unauthorized buildings may be legalized in Uzbekistan

Tashkent, Uzbekistan (UzDaily.com) -- On 22 February 2024, the Committee of the Legislative Chamber of the Oliy Majlis on Agrarian and Water Issues conducted a preliminary consideration of the bill “On the recognition of rights to unauthorizedly seized land plots and buildings and structures built in them.”

It was noted that in 2018, as part of a one-time nationwide action carried out in accordance with the relevant presidential decree, the ownership rights of more than 621 thousand citizens to their houses built without the appropriate permit on unauthorized occupied land plots for which cadastral documents were issued were recognized. But despite this, today more than 126 thousand citizens are waiting for a legal decision to determine the ownership of houses built without the appropriate permit.

In addition, in many cases, the ownership rights of citizens to suburban areas built on the territory of gardening and winegrowing partnerships, as well as to buildings and structures of business entities located on the territory of small industrial zones, are not recognized.

Based on this, there is a need to determine the basis and exact procedure for recognizing the right to houses, other buildings and structures or real estate built on unauthorized occupied land or without a decision of local government authorities.

The bill defines the procedure for recognizing the right to a land plot and a building built on it, as well as the right to lease on an unauthorized plot of land on which a private house is built.

The grounds for recognizing lease rights to overoccupied land plots occupied by residential buildings on the territory of horticultural and viticultural enterprises are also provided.

In addition, the procedure for changing the category of the land fund of a land plot with the right to lease, state registration of rights to a property, and privatization of a land plot with the right to lease is reflected.

It is noteworthy that the document provides that in the event of recognition of rights to an unauthorized land plot and buildings and structures built on it, persons who unauthorizedly occupied the land plot will be exempted from administrative liability.

It was noted that the adoption of the bill will serve to create a legal basis for registering the lease rights of citizens and business entities to unauthorized occupied land plots, as well as ownership rights to housing and other buildings and structures or real estate built on them.
