During procurement procedures, counterparties violated contractual obligations in the amount of 6.1 billion soums in 38 cases
Tashkent, Uzbekistan (UzDaily.com) -- In the course of studies conducted by the Department of Financial and Compliance Studies, problematic and unreliable counterparties were identified under 120 contracts that did not complete the supply of goods (works, services), delivered low-quality, expired or inadequate goods, and also allowed insufficient or negligent fulfillment of obligations under the terms of the agreement in 38 cases for the amount of 6.1 billion soums.
For example, in 2020–2021, in 2 cases, counterparties committed gross violations of contractual obligations and did not deliver goods in the amount of 4.7 billion soums;
Also, during the above period, counterparties in 16 cases as a result of failure to comply with the delivery deadline to the Company incurred a loss in the amount of 853.4 million soums, in connection with which, in the appropriate manner, a claim was submitted to the court to recover the loss;
It should be noted that there are also facts of delivery of goods that do not comply with the terms of the contract in terms of technical characteristics.
For example, in 4 cases, counterparties delivered goods in the amount of 107 million soums, which did not correspond to the terms of reference, and in 2 other cases, goods delivered for a total amount of 57 million soums became unusable before the expiration of the warranty period.
As a result of measures taken jointly with the responsible persons of enterprises (departments, factories, oil depots), in 82 cases under contracts with unreliable and problematic contractors, damage in the amount of 3.3 billion soums was prevented.
In particular, thanks to the measures taken, the delivery of goods that did not meet the technical specifications was prevented, thereby preventing damage to the Company in the amount of 2.2 billion soums.
Based on the results of the studies, a "list of suspicious and problematic counterparties" of Uzbekneftegaz JSC was compiled for negative cases in the performance of contractual obligations. Also, when participating in the procurement processes in the future, the proposals of these counterparties will be considered additionally in a controlled manner and, if necessary, restrictions on participation will be applied in accordance with the law.
Preventive work to eliminate and prevent such undesirable phenomena will continue.
