Improvement of administrative procedures discussed in Uzbekistan
Tashkent, Uzbekistan (UzDaily.com) -- Two-day seminars in Tashkent and Samarkand discussed improvement of administrative procedures in Uzbekistan.

Ministry of Justice of Uzbekistan, UNDP office in Uzbekistan and Japan International Cooperation Agency in Uzbekistan organized the event.

The main goal of the reforming of administrative procedures is to ensure that they were simple, clear and understandable for all, who addresses to the state bodies and other organizations.

Participants underlined that currently there is no single rules, which would regulate order and stage of adopting legal acts of individual character. This gap in legislative regulation sometimes is filled with by-laws. In the result, there is real threat for violation of rights and interests of citizens, and creation of administrative procedure, which protects interests of state body rather than protection rights and interest of citizens.

Experience of foreign states such as the USA, Germany, the Netherland, Japan and others show that administrative procedures are regulated by laws or similar document. It is clear that activities of state bodies and officials are regulated with the laws in legal states. It is actual for Uzbekistan to develop a law on administrative procedures, which would strengthen legal base for state governance, mechanism for realization of tasks and functions of the executive power.

Head of department on criminal, administrative and social legislation of the Ministry of Justice of Uzbekistan Mr. N. Toychiev said that lack of information on administrative procedures creates tension among population and they do not understand these procedures.

The draft law “On administrative procedures” was developed in 2005 and it included 140 articles. The document was agreed by the government and submitted to the Legislative Chamber of Oliy Majlis of Uzbekistan.

Foreign experts noted that the draft law of Uzbekistan “On administrative procedures” is fuller and better than similar documents of Georgia, Kazakhstan, Kyrgyzstan, some states in Eastern Europe, and others.

At the same time, the UN experts proposed to reform administrative procedures along with reforms in public service. This adheres to global practices and trends, which would increase efficiency of administrative procedures. They also proposed to adopt a law “On public service”, Code of Conduct for civil servants and develop Classifier of public servants.
