Instruction on use of measures on administrative responsibility to diplomats for road traffic violations approved
Tashkent, Uzbekistan (UzDaily.com) -- An instruction on implementation of measures of administrative responsibility to employees of diplomatic missions and consular establishments of foreign organizations, as well as related organizations, accredited in Uzbekistan, for violation of road traffic rules has been approved in Uzbekistan.

Ministry of Foreign Affairs, Ministry of Interior Affairs and Supreme Court approved the instruction with their joint resolution.

The document was adopted for attracting persons, using immunities, to administrative responsibility for violation of road traffic rules through complex of impact measures to person and their diplomatic missions.

In case of violation of road traffic rule by person, using immunity, police officers register a protocol on administrative violation in line with the legislation. At the same time, police officer returns driving license and other documents to the owner.

If the police officer has grounds that person, using immunity, drove car in a state of alcoholic, narcotic or other intoxication, he can ban person to drive car for security of other people and offer to undergo medical examination to determine alcoholic, narcotic or other intoxication level.

In this case, the officers informs the territorial department of interior affairs and Department on road traffic security, as well as the Ministry of Foreign Affairs on the issue and the information will be delivered to the diplomatic mission.

At the same time, the police offers have no right to make requests, which can be evaluated as search and inspection.

If the person, who uses immunity, refuses to stop on request of the police officer, the corresponding act will be registered. The act will be signed by police officer and two witnesses.

The instruction also includes rules on registration of traffic accidents with participation of persons with immunity and reasons for stopping cars of the diplomats.

The police officer can request leave cabin of the car only to eliminate technical problems of the car, violation of rules of cargo transportation, in state of alcoholic, narcotic or other intoxication, as well as driver or passengers are suspected in administrative violations or crimes.

In case of violation of road traffic rules by the persons with immunities, the protocol of administrative violation and other documents will be directed to Diplomatic Service of the Ministry of Foreign Affairs (DS), which will send notification to diplomatic mission.

Court or other authorized body adopts decision on administrative punishment for violation after DS receives notification from the diplomatic mission on their consent to bring violator to administrative responsibility. After the decision of the court, DS sends decision to the diplomatic mission for execution.

The DC will create a database of persons with immunities, who violated road traffic rules. The database will include protocols of administrative violations and decisions of the courts or other authorized body on bringing persons to administrative responsibility.

The fines will be paid to cash office of the DS and money will be transferred to corresponding transit accounts. If the punished person refuses to execute decision of the court and other authorized body, the DS will not render transport services (registration of car, registration of state number plates, technical examination, etc) till implementation of the administrative punishment.

The instruction includes other punishments and measures against persons with immunities, who violated road traffic rules, including revoking number plates, expulsion from the country, abolishment of accreditation, etc.
