No one can be deprived of his home except by a court decision and in accordance with the law

Tashkent, Uzbekistan (UzDaily.com) -- At the fifty-second plenary meeting of the Senate of the Oliy Majlis, senators discussed the Law “On Amendments and Additions to Certain Legislative Acts of the Republic of Uzbekistan”.

The law introduces amendments and additions to the Housing Code, the laws “On Guarantees of Freedom of Entrepreneurial Activity” and “On Procedures for the Confiscation of Land Plots for Public Needs with Compensation” and the Town Planning Code.

In addition, the Housing Code stipulates that modification of the appearance, reconstruction or demolition of residential premises is carried out in accordance with the legislation on urban planning.

The law stipulates reliable protection of private property rights and interests of business entities, while no one can be deprived of their home except by a court decision and in accordance with the law.

It is established that the owner deprived of his home is provided with preliminary and equivalent compensation for the cost of housing and losses incurred by him in cases and in the manner prescribed by law.

As is known, hazardous processes associated with floods and landslides are becoming more active every year as a result of climate change.

From this point of view, in order to prevent unfavorable situations associated with floods and landslides, ensure the safety of life of the population, and reduce the amount of economic damage caused, a new norm is being introduced into the Town Planning Code prohibiting the development, approval and implementation of town planning documents in the design and construction of buildings and structures on mudflow and landslide hazardous areas.

At the same time, the Law “On Guarantees of Freedom of Entrepreneurial Activities” enshrines a new rule that the free movement of goods, services, labor resources and financial resources of business entities is guaranteed on the territory of the Republic of Uzbekistan, regardless of the territory of their state registration, and restrictions are not allowed , suspension and prohibition of their free movement on a territorial basis.

The senators noted that this Law is intended to strengthen guarantees for the protection of private property and the rights of owners, to create additional guarantees and conditions for the free implementation of business activities.

The law was approved by senators.
