Majilis of the Parliament of Kazakhstan approved amendments to the law "On the use of the airspace of the Republic of Kazakhstan and aviation"

Tashkent, Uzbekistan (UzDaily.com) -- The Majilis of the Parliament of Kazakhstan in the first reading approved amendments to the articles of the law "On the use of the airspace of the Republic of Kazakhstan and aviation". According to Kazakhstani sources, the amendments are being made to ensure flight safety and reduce the operation of obsolete civil aircraft by Kazakhstani operators.

According to the amendments, it is planned to exclude from the register of aircraft and helicopters over 40 years old, which have not had a certificate of airworthiness for more than a year. In the substantiation of the bill, it is noted that the experience of Italy is taken as a basis, where aircraft manufactured before 1975 are not registered.

Another limitation concerns the service life of aircraft intended for the carriage of goods. In particular, it must not exceed 25 years. The service life proposal for cargo aircraft is based on the experience of Jordan, the United Arab Emirates, Colombia, Egypt, India, Indonesia, Italy, Pakistan, Thailand, where the average limitation of the calendar life of aircraft is 22 years. The resource for the number of flights and hours is derived from the experience of India, Nepal and Pakistan, where the figure is 67% of the established factory resource.

In addition, the law introduces a requirement for the availability of equipment that transmits data on the state and location of the aircraft, as well as the obligation of local airlines to carry out more than half of the flights per year within Kazakhstan.

The reason for the introduction of this norm was the information of the UN Security Council, which in February 2020 reported that the aircraft with Kazakhstani registration violated the Security Council embargo on the supply of weapons to Libya. This happened due to the fact that the airline, receiving a Kazakhstani certificate of a civil aircraft operator, can be permanently based at foreign airfields and operate flights outside the country. At the same time, such airlines become unavailable for Kazakhstani inspection.

In general, experts emphasize that the entry into force of innovations in aviation legislation will, firstly, improve flight safety, and secondly, reduce the risk of Kazakhstani airlines being blacklisted by international organizations.
