Legislative Chamber approves law strengthening constitutional guarantees for judiciary

Tashkent, Uzbekistan (UzDaily.com) —  Legislative Chamber of the Oliy Majlis of Uzbekistan has approved, in its second reading, the draft law "On Amendments and Additions to Certain Legislative Acts of the Republic of Uzbekistan in Connection with Strengthening Constitutional Guarantees for the Activities of Courts."

During the discussion, it was emphasized that comprehensive reforms are being implemented in the country to protect human rights, freedoms, and legal interests, as well as to strengthen constitutional, legal, institutional, and practical guarantees.

The proposed amendments concern the "Law on Courts" and the "Law on the Higher Judicial Council of the Republic of Uzbekistan," which are being aligned with the new version of the Constitution.

Specifically, under the changes to the "Law on the Higher Judicial Council of the Republic of Uzbekistan," the composition of the Council, including the chairman, deputy chairman, members, and secretary, will be elected by the Senate of the Oliy Majlis based on the President’s proposal. Additionally, no individual will be allowed to hold the position of chairman or deputy chairman of the Higher Judicial Council for more than two consecutive terms.

Under the amendments to the "Law on Courts," justice will be administered exclusively by courts, and judicial decisions that have entered into force will become binding not only for all government bodies, enterprises, institutions, organizations, officials, and citizens but also for civil society institutions.

Furthermore, the rights of citizens to appeal unlawful decisions, actions, or inactions will be strengthened, not only against government bodies but also against other organizations. The principles of presumption of innocence and the "Habeas Corpus" institute will also be introduced.

The adoption of this draft law will ensure judicial independence, enhance guarantees for the judiciary, and promote the protection of individual rights and freedoms through the courts.

The draft law was approved by the deputies in its second reading.
