Criminal and administrative liability for violation of legal requirements related to urban planning is increasing

Tashkent, Uzbekistan (UzDaily.com) -- At the next plenary meeting, in the first reading, the draft law “On amendments and additions to some legislative acts of the Republic of Uzbekistan in connection with the improvement seismic safety systems.”

In recent years, the country has implemented large-scale comprehensive measures to develop seismology, seismic resistance of structures and seismic safety, and to radically increase the efficiency of industry organizations.

At the same time, there is a need to strengthen the responsibility of organizations for increasing the seismic resistance of buildings and structures under construction and reconstruction in our republic, to strengthen control over strict compliance with the requirements established by urban planning legislation, and also to increase the effectiveness of punishment for committed offenses and crimes.

The bill proposes to strengthen criminal and administrative liability for violation of legal requirements related to urban planning. Also, in order to prevent corruption in inspections or courts, it is proposed to establish a uniform amount of administrative fines, that is, to abandon the current norm providing for the determination of the amount of the fine within the range from and to a certain amount.

In addition, corresponding changes and additions are being made to the Criminal and Criminal Procedure Codes of the Republic of Uzbekistan. In particular, the sanctions of the current Article 2293 of the Criminal Code have been strengthened and criminal liability has been established for unauthorized construction contrary to master plans, violation of the rules for accepting objects into operation, demolition of basement structures and the first floors of apartment buildings.

For these crimes committed after the application of administrative punishment provided for in Article 2293, a penalty is established as correctional labor (up to 3 years) or restriction of freedom, imprisonment for the same period, and also, if it led to the death of people or causing other grave consequences, it is provided restriction of freedom (up to 5 years) or imprisonment for the same period.

The adoption of the bill will serve to prevent cases of illegal construction and other violations in the field of urban planning, ensure compliance with approved master plans, as well as preserve the health, life and safety of the population, improve the quality of construction, reduce crimes and increase the effectiveness of punishment.

At the meeting, the draft law was adopted by deputies.
