Tashkent, Uzbekistan (UzDaily.com) -- On 21 February, in the building of the Supreme Court of the Republic of Uzbekistan with the participation of members of the Senate of the Oliy Majlis and the Legislative Chamber, judges of the Supreme Court, senior officials of the Information and Mass Communications Agency, law enforcement agencies, as well as representatives of the media, discussion of the draft decision of the Plenum “On ensuring transparency of the judicial process and the right of access to information on the activities of the courts” was held.
Several democratic norms were unanimously approved in the draft, such as the free participation of the media in open court hearings and the receipt of information, for which the courts will create the necessary conditions. The discussion of the cases will be open to all, information on the course of the discussion of the case behind closed doors will be clearly indicated on the court’s website.
On the issue of taking photographs and audio recordings of an open trial in a criminal, administrative or economic case, administrative offenses, paragraph 14 of the Decision states that they are allowed only with the permission of the chairman of the court. Media representatives have restrictions on audio, video, shorthand, and written records. The agency voiced its suggestions and comments on this matter.
It was noted that the journalist should be free to carry out audiovisual activities in an open trial (with the exception of civil cases) due to the fact that thanks to audiovisual information it is easier and more convenient to prepare material, and also minimizes the risk of errors and inaccuracies, and a journalist will not be held responsible for disseminating false information.
During the discussion, representatives of the Agency stated that similar issues have their legislative regulation in other countries, for example, in Russia, Belarus, etc., and suggested that as a next step in the democratization of the judicial process, a draft law “On the transparency of the courts” be prepared. initiated by the Supreme Court of the Republic of Uzbekistan.
At the end of the meeting, a Plenum Decision was adopted “On ensuring transparency of the judicial process and the right of access to information on the activities of the courts” taking into account well-founded proposals and objections.
