Tashkent, Uzbekistan (UzDaily.com) - The Antimonopoly Committee of the Republic of Uzbekistan conducts regular work to assess the impact of draft regulatory acts posted on regulation.gov.uz, as well as through the Unified Electronic System for the development and approval of regulatory projects legal acts (project.gov.uz).
It is important that the draft resolution of the Cabinet of Ministers of the Republic of Uzbekistan “On additional measures to protect consumer rights and improve work to assess the conformity of consumer products, as well as create favorable conditions for business entities” (ID-8037), developed by the Uzstandard Agency, the Committee studied immediately after its publication.
The project envisages a number of cases that can affect the interests of individuals and legal entities, business entities, and can also affect the competitive environment.
So, clause 2 of the project states that in the absence at the time of certification of an accredited testing laboratory (center) for a given type of product (type of test), the certification body can determine the possibility, as well as the place and conditions of testing, ensuring the objectivity of their results.
According to the Committee, the choice of a testing laboratory at the discretion of the certification body, as well as determining the test conditions without the participation of the customer, can lead to corruption.
Based on this, the Committee proposed to determine the possibility, as well as the place and conditions of testing, by the certification body in agreement with the customer.
In addition, the project stipulates the release into free circulation in the Republic of Uzbekistan of energy-consuming products, which according to Appendix No. 2 from January 1, 2020 should be carried out by official representatives of the manufacturer’s factory (official dealers) only if there is at least one service center in the Republic of Karakalpakstan , regions and the city of Tashkent.
Based on the fact that these measures may lead to additional costs of the manufacturer’s factory (business entity), reduction of market participants, and also affect the interests of consumers, the Committee made a proposal to exclude this item.
Thus, the Antimonopoly Committee sent appropriate recommendations on the revision of the above items to the project developer - Uzstandard agency.
